Algemene Voorwaarden / Terms of Service

1. Definitions

  • "GrowMachine" / "we" / "us": the GrowMachine service operated by Zero Creative, based in the Netherlands.
  • "User" / "you": any person or entity using the GrowMachine platform.
  • "Service": the GrowMachine web application for managing automated social media advertising campaigns.
  • "Platform(s)": third-party social media networks (Instagram, TikTok, LinkedIn, YouTube, X).

2. Service Description

GrowMachine is a SaaS platform that uses AI to create, manage, and optimize advertising campaigns on social media platforms on your behalf. We manage campaign setup, ad creative generation, audience targeting, and budget optimization. Ad spend is processed directly by the connected platforms (e.g., Meta Ads) — GrowMachine does not handle your ad budget funds.

3. Account & Eligibility

  • You must be at least 18 years old to use GrowMachine.
  • You must provide accurate and complete registration information.
  • You are solely responsible for the security of your account credentials.
  • You may not use GrowMachine for illegal purposes or to violate any third-party advertising policies.

4. Connected Accounts & Authorizations

By connecting a social media account, you authorize GrowMachine to create and manage advertising campaigns through that platform's API on your behalf. You may revoke this authorization at any time by disconnecting the account in your dashboard. You remain the owner of your social media accounts at all times.

5. Ad Budget & Payments

  • Ad budgets you set are spent through your own connected advertising accounts (e.g., your Meta Ads account).
  • GrowMachine does not collect, hold, or process your ad spend.
  • You are solely responsible for payments to the advertising platforms.
  • GrowMachine service fees (if applicable) are billed separately and stated clearly before any charge.

6. No Guarantee of Results

GrowMachine optimizes campaigns using AI, but we cannot and do not guarantee specific follower counts, engagement rates, impressions, or any other results. Performance depends on many external factors including your industry, content quality, audience, platform algorithms, and budget. Any estimates shown are indicative only and not binding.

7. Platform Compliance

You agree to comply with the advertising policies and terms of service of all connected platforms. GrowMachine is not responsible for account suspensions, ad rejections, or penalties imposed by third-party platforms. We make reasonable efforts to comply with platform policies, but cannot guarantee approval of all ad content.

8. Intellectual Property

  • AI-generated ad copy and creatives produced for your campaigns are yours to use freely.
  • The GrowMachine platform, brand, logo, software, and technology are and remain the intellectual property of Zero Creative.
  • You may not copy, reverse-engineer, or redistribute any part of the GrowMachine platform.

9. Limitation of Liability

To the maximum extent permitted by Dutch law:

  • GrowMachine is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, lost followers, or lost advertising spend.
  • Our total aggregate liability for any claim shall not exceed the amount you paid to GrowMachine (not including ad spend to platforms) in the 12 months preceding the claim.
  • We are not liable for downtime, errors, or interruptions caused by third-party platforms, internet providers, or force majeure events.

10. Termination

  • You may delete your account at any time from your dashboard settings. All personal data will be deleted within 30 days.
  • We may suspend or terminate accounts that violate these terms, abuse the platform, or violate advertising policies.
  • Upon termination, active campaigns will be paused. You remain responsible for any pending ad spend to platforms.

11. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use after changes take effect constitutes acceptance of the updated terms.

12. Governing Law & Disputes

These terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these terms or the use of GrowMachine shall be submitted to the competent court in the Netherlands. For consumers within the EU, mandatory consumer protection laws of your country of residence apply in addition to these terms.
